INFOMEDIJI - CREATOR CAMPAIGN TERMS AND CONDITIONS
(Create Beyond)
Welcome to the Terms and Conditions (Conditions) for “Create Beyond”, a creator campaign offered by INFOMEDIJI, with the sponsorship of PICO. PICO is a sponsor of the Campaign and is not a party to these Conditions, save as expressly provided in Clause 20.2. Under the Campaign, selected creators (the Creator) produce and deliver original VR video content (the VR Content) in exchange for production funding, awarded in accordance with these Conditions. By submitting a Proposal, or otherwise participating in the Campaign, you agree to be bound by these Conditions, including the rules on use of the Website set out below. Any matter relating to the Campaign not expressly addressed in these Conditions shall be determined by INFOMEDIJI, at its sole discretion, and such determination shall be final and binding.
By submitting a Proposal or otherwise participating in the Campaign, you warrant that you are aged 18 years or over and, in order to receive Funding, that you are incorporated or otherwise able to engage in business with INFOMEDIJI. Natural persons unable to invoice or contract with INFOMEDIJI on a business basis are not eligible for Funding.
1. Interpretation
In these terms and conditions:
“Campaign” means the creator campaign named “Create Beyond”, under which Creators submit Proposals, produce and deliver original VR Content, and are awarded production funding upon selection and approval, as described in detail in Schedule 2.
“Campaign Rules” and “Rules” means Conditions 15 to 23 inclusive hereunder.
“Conditions” means these Creator Campaign Terms and Conditions.
“Content Licensing Agreement” means the separate written agreement between a Selected Creator and INFOMEDIJI, entered into prior to the commencement of production and the receipt of any Funding, which shall incorporate the terms set out in Section 20.
“Creator” means a sole trader, company, or other legal entity that submits a Proposal, produces and delivers VR Content, or otherwise participates in the Campaign, subject to the eligibility requirements (including the business-capacity requirement) set out in Clause 18.4.1.
“DeoVR Content Team” means the internal INFOMEDIJI team responsible for reviewing Proposals and VR Content submitted under the Campaign.
“DeoVR Monetization Program” means the Website’s revenue-sharing programme for published content, participation in and eligibility for which is subject to the DeoVR Terms.
“DeoVR Terms” means the terms and conditions, content guidelines, and community standards published on the Website, available at deovr.com/pages/terms, or any successor page designated by INFOMEDIJI, as may be updated from time to time.
“Force Majeure Event” means any event outwith the reasonable control of INFOMEDIJI, including but not limited to: act of god, explosion, flood, tempest, fire or accident, extreme weather, war or threat of war, sabotage, pandemic flu or virus, insurrection, civil disturbance or requisition, acts, restrictions, regulations, bye-laws, prohibitions or measures or any kind on the part of any governmental, parliamentary or local authority, strikes, lock-outs or other industrial actions, power cuts or trade disputes (whether involving Our employees or of a third-party).
“Funding” means the production funding of up to USD 1,000 (One Thousand United States Dollars), the amount of which is determined following review of a Proposal and/or the final VR Content as described in Sections 18 and 19 and detailed in Schedule 1 of this document, and which is payable to a Creator in accordance with Clause 19.3.
“INFOMEDIJI” and “We / Us / Our” means INFOMEDIJI, spletne storitve, d.o.o. a company registered in Slovenia (Company ID: 6450784000) and with its registered office at Tehnološki park 19, 1000 Ljubljana, Slovenia.
“Information” means any and all material contained on the Website.
“Intellectual Property” means any VR Content, patent, invention, copyright, database right, registered or unregistered design, trademark (whether registered or unregistered), trade name, logo, trade secrets, know-how or other industrial or intellectual property right subsisting anywhere in the world, and applications for any of the foregoing, together with the goodwill thereon.
“PICO” means PICO Technology Co., Ltd., a sponsor of the Campaign, providing promotional assets, Key Visual (KV) design, financial sponsorship support, content review (together with DeoVR’s Content Team), and distribution of approved VR Content via PICO TV.
“PICO Community Guidelines” means the Community Guidelines for PICO Virtual Experiences published by PICO, available at https://www.picoxr.com/global/legal/community-guide, or any successor page designated by PICO, as may be updated from time to time.
“PICO TV” means PICO’s official video hosting and distribution platform where approved VR Content will be published for viewing, in addition to the Website.
“Proposal” means the concept and production plan submitted by a Creator to INFOMEDIJI via [email protected], as described in Clause 18.4.3.1.
“Proposal Submission Deadline” means the date by which a Proposal must be submitted to INFOMEDIJI, as set out in Schedule 2.
“Review Period” means the period(s) during which Proposals and/or final VR Content are evaluated by the DeoVR Content Team and PICO in accordance with the Campaign Rules.
“Selected Creator” means a Creator whose Proposal has been approved for participation in the Campaign.
“Submission Process” means the three-stage process described in Clause 18.4.3 (Proposal, First Cut, Final Delivery) by which VR Content is submitted to INFOMEDIJI and PICO.
“the User” and “you” means the user of the Website.
“the VR Content” means the virtual reality or other video content submitted by the Creator, for the purposes of the Campaign, in accordance with the requirements set out in Clause 18.4.
“the Website” and “DeoVR” means DeoVR website, operated by INFOMEDIJI operating under URL https://deovr.com/, where approved VR Content will also be published for viewing, in addition to PICO TV.
“VR” means virtual reality.
2. Basis of Use of the Website
You agree to the following:
2.1 that you understand, acknowledge and accept the exclusion of liability and disclaimer provisions contained hereafter;
2.2 that you will only view the Information for your own private purpose and will not publish, reproduce, store or retransmit any of the Information contained in the Website at any time;
2.3 that you shall not use the Information for any unlawful purpose or in any unlawful manner;
2.4 that you shall not use the Website or the Information in any manner which may constitute an infringement of any third-party rights (including but not limited to rights of copyright, trademark or confidentiality);
2.5 that you shall not run any tools on the Website that systematically retrieve web pages for offline or online viewing; whether it be for personal, commercial, experimental, educational or any other use;
2.6 that all intellectual property rights (including without limitation copyright, trademarks and all other rights) whatsoever in the Information and the Website shall remain vested in INFOMEDIJI at all times;
2.7 that you acknowledge that INFOMEDIJI has no obligation to provide the Website or any Information or to ensure that you are able to use, provide and/or access the Information, and the Website;
2.8 that you will indemnify and keep indemnified INFOMEDIJI against all claims, liabilities, damages, costs and expenses including legal fees arising out of any misuse of the Information or the Website or breach of your obligations under this agreement.
2.9 that you are solely responsible for interactions with other Users of the Website and that you are solely responsible for all Content and VR Content that you publish or post to the Website or transmit to other Users of this Website.
In addition, you agree that you will not:
2.10 say or do anything that would cause annoyance, inconvenience, harassment or needless anxiety to others;
2.11 advertise or promote third party or Your own products or services including by way of the distribution of ’spam’ mail;
2.12 use foul, threatening or offensive language including, without limitation, racist, sexist, ageist, homophobic or sexually explicit language where inappropriate;
2.13 make insulting remarks to or about other Users (“flaming”);
2.14 jump in and out of Website forum rooms (“frogging”);
2.15 distribute illegal, copyright infringing, indecent or offensive material or any messages or content that may incite disorder or encourage illegal activities or that causes or may cause harm to minors;
2.16 impersonate another person, User, or any other Website user, etc.
2.17 transfer files that contain viruses, trojans or other harmful programs;
2.18 use the Website to conduct any fraudulent activity including any “pyramid scheme”; “ponzi scheme” or “chain letter”;
2.19 access or attempt to access the accounts of other Users or to penetrate or attempt to penetrate the Website security measures;
2.20 include in public, any personal data on this Website any telephone numbers, street addresses, email addresses and;
2.21 include in any content, the address of an internet Website.
2.22 point your personal homepage link to a website to which you do not have full file transfer access.
3. Data Protection
INFOMEDIJI considers the protection of personal information to be very important. For further information please read Our Privacy Policy.
INFOMEDIJI is the controller of personal data for the purposes of the Campaign. Creators acknowledge and agree that INFOMEDIJI may transfer personal data internationally, including to Slovenia (where INFOMEDIJI is based) and, to the extent PICO is involved in reviewing Proposals and VR Content as sponsor of the Campaign, to PICO, located in China. Any such sharing with PICO will be limited to personal data reasonably necessary for PICO’s participation in the review process and will be subject to appropriate safeguards for international data transfers.
4. Proprietary Rights
All Intellectual Property Rights in the materials on the Website (as well as the organisation and layout of the Website) together with the underlying software code are owned by, licensed or authorised to INFOMEDIJI, its assignees, licensees or sub-licensees thereof and the copyright in the text, artwork, graphics and images on the Website are owned by, licensed or authorised to INFOMEDIJI or its licensors or its content or technology providers except where otherwise specified. Nothing in these Conditions transfers to you any rights of ownership of such intellectual property rights, or constitutes a licence to use such intellectual property rights other than to the extent expressly set out in these Conditions. Without Our prior written permission, you may not copy, modify, alter, publish, broadcast, distribute, sell or transfer any material on the Website or the underlying software code whether in whole or in part. However, the contents of the Website may be downloaded, printed or copied for your personal non-commercial use.
5. Disclaimer
5.1 To the fullest extent permitted at law, the Website and its contents is provided on an “as is” basis and makes no (and expressly disclaims all) representations or warranties of any kind, with respect to the Website or its contents or their suitability, reliability or usefulness for any purpose.
5.2 In addition, INFOMEDIJI does not represent or warrant that the information accessible via the Website is accurate, complete or current.
5.3 While every effort is made to ensure accurate and complete information, INFOMEDIJI, nor its directors, employees or representatives will be liable for damages arising out of or in connection with the use of the Website or the information, content, materials or products included on the Website. This is a comprehensive limitation of liability that applies to all damages of any kind.
6. Changes
We reserve the right at any time without notice to revise the contents of the Website including these Conditions. Any changes to these Conditions will be posted on the Website and by continuing to use the Website following any such change you will be agreeing to be bound by the revised Conditions.
7. Acceptable Use
7.1 You may only use the Website in accordance with the DeoVR Terms and, in any event, for lawful and proper purposes which includes complying with all applicable laws, regulations and codes of practice. For the avoidance of doubt, all VR Content published on the Website as part of the Campaign must also comply with the DeoVR Terms, and INFOMEDIJI reserves the right, in its sole discretion, to disqualify any submission that violates them.
7.2 You acknowledge that we may be required by law or regulation to access, monitor, store or copy material sent by or to Creators without further notice to you.
8. Links to Other Websites
8.1 The Website may include links to other Internet sites. We do not endorse any such websites and We are not responsible for the information, material, products or services contained on or accessible through those websites. Your access and use of such websites remains solely at your own risk.
8.2 You may only link to the Website with Our express written permission. We expressly reserve the right to withdraw Our consent at any time to a link which in Our sole opinion is inappropriate or controversial.
9. Limitation of Liability
In no event will We or PICO be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of access to, or the use of the Website or any information contained in it, including loss of profit and the like whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages.
10. Disclaimer of Warranty
To the maximum extent permitted by law, We disclaim all implied warranties with regard to the information, services and materials contained on the Website. All such information, services and materials are provided “as is” and “as available” without warranty of any kind.
11. Force Majeure
Neither party shall be liable for any breach of these Conditions caused by a Force Majeure Event.
12. Dispute Resolution
Should any dispute arise out of these Conditions, parties consent to exclusive jurisdiction of courts of Ljubljana, Slovenia.
13. Assignation
INFOMEDIJI shall be entitled to subcontract, assign or transfer Our obligations or rights to a competent third-party or to any associated company whether in whole or in part. The User may not assign or transfer any of its rights or obligations without Our written consent.
14. Miscellaneous
These Conditions contain all the terms of your agreement with Us relating to your use of this Website. No other written or oral statement (including statements in any brochure or promotional literature published by Us) will be incorporated. Your use of this Website, any downloaded material from it and the operation of these Conditions shall be governed by, construed and interpreted in accordance with the law of Slovenia and you agree to submit to the jurisdiction of the Slovenian courts.
Campaign Rules
15. Campaign Organiser
The Campaign is organised by “INFOMEDIJI” and “We / Us / Our” means INFOMEDIJI, spletne storitve, d.o.o., a company registered in Slovenia (Company ID: 6450784000) and with its registered office at Tehnološki park 19, 1000 Ljubljana, Slovenia, with the sponsorship of PICO.
16. Events outwith Our control
INFOMEDIJI reserves the right to cancel or amend the Campaign or the Campaign Rules without notice in the event of a Force Majeure Event. Any changes will be posted within these Conditions on the Website. A copy of the Rules may also be requested by emailing [email protected].
17. Disputes
In the event of any dispute regarding the Rules, conduct, review outcomes, Funding decisions and all other matters relating to the Campaign, the decision of INFOMEDIJI shall be final and no correspondence or discussion shall be entered into.
18. Applying to the Campaign
18.1 This Campaign is open to Creators who meet the eligibility criteria set out in Clause 18.4 below. To participate, a Creator must submit a Proposal (a concept and production plan) to [email protected] by the Proposal Submission Deadline set out in Schedule 2. The Proposal Submission Deadline is a target date only, and INFOMEDIJI reserves the right, at its sole discretion, to continue accepting and reviewing Proposals after that date, including on a rolling basis, for so long as places remain available in the relevant track. Selected Creators will receive confirmation by email and must enter into a Content Licensing Agreement before commencing production or receiving any Funding. Up to ten (10) Creators will be selected for each of Track 1 (Vlog) and Track 2 (Open Track), awarded in order of review approval until all available places for that track have been filled. INFOMEDIJI does not guarantee that all available places will be filled, and Proposals will only be approved if they meet the review criteria set out in Clause 19.2.
18.2 By submitting a Proposal or otherwise participating in the Campaign, you hereby warrant that all information submitted by you is true, current and complete. INFOMEDIJI reserves the right to verify the eligibility of all Creators.
18.3 INFOMEDIJI reserves the right to disqualify any Creator, or to withdraw or withhold Funding, if it has reasonable grounds to believe the Creator has breached any of the Conditons, or has made any false, inaccurate or misleading statement or representation to INFOMEDIJI and/or PICO in connection with the Campaign, on which INFOMEDIJI and/or PICO has relied.
18.4 The Creator understands and agrees that there are eligibility, technical and process requirements applicable to participation in the Campaign. Failure to comply may lead to a Proposal being rejected, or a Creator being disqualified, subject to these additional conditions.
18.4.1 Creator Eligibility. The following conditions relate to any Creator who wishes to submit a Proposal:
18.4.1.1 Applicants must own professional immersive content capture equipment, or demonstrate the ability to produce immersive content using CG tools or game engines (e.g. Unreal Engine, Unity).
18.4.1.2 All submitted VR Content must be original. Creators must own or control all necessary Intellectual Property Rights in the VR Content and have the authority to grant INFOMEDIJI and PICO the licence described in Clause 20 below.
18.4.1.3 To receive Funding, the Creator must be incorporated (e.g. as a company or sole proprietorship) or otherwise able to engage in business with INFOMEDIJI, including by issuing a valid invoice. A natural person who is not able to invoice or otherwise contract with INFOMEDIJI on a business basis is not eligible to receive Funding, notwithstanding any other provision of these Conditions.
18.4.2 Content Requirements. The following additional conditions relate to the VR Content itself:
18.4.2.1 The VR Content must align with one of the two tracks described in Schedule 2 (Track 1: Vlog, or Track 2: Open Track), and must correspond to the theme of the Campaign. INFOMEDIJI reserves the right to disqualify any VR Content that does not reasonably correspond to a track, at its sole discretion.
18.4.2.2 Resolution and format. The VR Content must be a minimum resolution of 8K and a minimum of 30 FPS, shot with professional VR cameras or produced using high-quality CGI/game engines. The VR Content must be submitted in MP4 or MOV format, and must be in VR180 3D, VR360 2D, or VR360 3D. Stereoscopic (3D) VR is highly encouraged.
18.4.2.3 Length. The VR Content must be a minimum of three (3) minutes in length, with a clear creative direction, engaging pacing, and a cohesive viewing experience, and not merely a collection of clips.
18.4.3 Submission Process. Proposals and VR Content shall be submitted in accordance with the following three-stage process:
18.4.3.1 Step 1 – Proposal. The Creator submits a concept and production plan to [email protected] (cc: [email protected]) by the Proposal Submission Deadline set out in Schedule 2, provided that INFOMEDIJI reserves the right, at its sole discretion, to continue accepting and reviewing Proposals after the Proposal Submission Deadline (including on a rolling basis) until all available places referred to in Clause 18.1 have been filled. Selected Creators will receive confirmation and a Content Licensing Agreement.
18.4.3.2 Step 2 – First Cut. The Selected Creator uploads a first cut of the VR Content to Google Drive, using the link or folder provided by INFOMEDIJI, by the First Cut Deadline set out in Schedule 2, which INFOMEDIJI may extend at its sole discretion (including where the Proposal Submission Deadline has been extended in accordance with Clause 18.1), and will receive feedback from the DeoVR Content Team and PICO on storytelling, editing and VR presentation.
18.4.3.3 Step 3 – Final Delivery. The Selected Creator uploads the final version of the VR Content to Google Drive, in accordance with instructions provided by INFOMEDIJI, by the Final Delivery Deadline set out in Schedule 2, which INFOMEDIJI may extend at its sole discretion (including where the Proposal Submission Deadline and/or First Cut Deadline have been extended in accordance with Clauses 18.1 and 18.4.3.2). The final VR Content will undergo technical and content review before publishing. Where the final VR Content does not pass such review, INFOMEDIJI may, at its sole discretion (having taken into account any input from the DeoVR Content Team and PICO), permit the Creator a reasonable opportunity to revise and resubmit the VR Content, or reject the Proposal entirely with no Funding payable, and INFOMEDIJI reserves the right to disqualify any VR Content that fails such review, at its sole discretion.
18.4.3.4 If a Selected Creator fails to meet the Proposal Submission Deadline, First Cut Deadline or the Final Delivery Deadline set out in Schedule 2, INFOMEDIJI may, at its sole discretion, either grant a reasonable extension of the relevant deadline or treat the delay as grounds to disqualify the Creator and withhold or forfeit any Funding, without any obligation to do either.
18.4.3.5 VR Content may also be subject to additional territory-specific content or compliance requirements notified to the Creator by INFOMEDIJI (based on requirements provided by PICO) from time to time, including in relation to Mainland China, and compliance with any such requirements shall be a condition of publication and of receiving Funding.
18.4.3.6 For clarity, the key dates for the Campaign are set out in Schedule 2. INFOMEDIJI reserves the right to update the Campaign timeline, funding structure, or other Campaign details where reasonably necessary. Material changes will be communicated to Creators in advance whenever practicable.
19. Funding
19.1 Funding is awarded based on editorial and quality review of the Proposal and, subsequently, the final VR Content, carried out by PICO and the DeoVR Content Team. Funding is not guaranteed for every Proposal, and Funding amounts (up to the maximum set out in Schedule 1) will be determined following such review and confirmed to Selected Creators by email.
19.2 Every Proposal and final VR Content shall be assessed holistically by PICO and the DeoVR Content Team against the following criteria: Visual Quality (including resolution, image quality, colour accuracy, stitching quality, image stability and overall production quality); Storytelling & Production (including clarity of concept, narrative structure, pacing and editing); Immersive Experience (including viewer comfort, spatial presence, camera movement and motion sickness); Creative Merit (including originality, creativity, unique perspective, and cultural, educational, artistic or entertainment value and audience appeal); and Compliance (including compliance with applicable laws and with the DeoVR Terms and PICO Community Guidelines, and the absence of illegal, infringing, misleading, violent or otherwise prohibited content). Review shall be conducted at the sole discretion of INFOMEDIJI and PICO, and all decisions regarding the application of these criteria and the award of Funding shall be final and binding.
19.3 Funding will be paid in a single instalment after the approved VR Content has been completed, delivered, reviewed by PICO and the DeoVR Content Team, and formally accepted by INFOMEDIJI. In exceptional circumstances, INFOMEDIJI may approve milestone-based or advance payments for a Proposal that requires advance production funding.
19.4 Payment of any Funding is conditional upon (a) the Selected Creator meeting the eligibility requirements set out in Clause 18.4.1.3, and receipt of (b) a signed Content Licensing Agreement, (c) a valid invoice, and (d) any applicable tax documentation, from the Selected Creator.
19.5 Funding is non-transferable and no alternative will be provided, except as expressly approved by INFOMEDIJI. Where, for reasons beyond INFOMEDIJI’s reasonable control, including but not limited to legal, regulatory, financial, banking, payment service provider, sanctions, or compliance restrictions, or the non-receipt, delay, reduction or withholding of funding from PICO or any other sponsor of the Campaign, INFOMEDIJI is unable to pay any Funding as described, INFOMEDIJI may delay or adjust the Funding in accordance with this Clause or, where such a solution is not reasonably practicable or would impose a disproportionate burden on INFOMEDIJI, forfeit the Funding entirely. In such circumstances, the affected Creator shall have no entitlement to any alternative compensation or claim against INFOMEDIJI.
19.6 All taxes, bank fees, transfer fees and any other charges associated with the receipt of Funding shall be the sole responsibility of the Creator.
19.7 INFOMEDIJI reserves the right, in its sole discretion, to cancel or reduce the scope of the Campaign if an insufficient number of qualifying Proposals are received during the Submission Process, or if the Proposals and/or VR Content received do not meet the quality or other standards set out in Clause 19.2. In the event of such cancellation, no Funding shall be awarded in respect of Proposals not already approved, and Creators shall have no entitlement to, or claim against, INFOMEDIJI or PICO arising from or in connection with such cancellation.
19.8 To remain eligible for Funding and any DeoVR Monetization Program opportunities, approved VR Content must remain available on both PICO TV and the Website, in accordance with the licence granted under Clause 20.2.
20. Intellectual Property Rights
20.1 All Intellectual Property Rights in the VR Content shall be, and remain, owned by the Creator.
20.2 The Creator hereby grants to INFOMEDIJI and PICO a perpetual, worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, reproduce, modify (where necessary), display, publish and otherwise distribute the approved VR Content on the Website and on PICO TV, for long-term availability on both platforms. The Creator acknowledges and agrees that PICO is entitled to directly enforce, and to receive the benefit of, the licence granted to PICO under this Clause 20.2, notwithstanding that PICO is not a party to these Conditions or to the Content Licensing Agreement.
20.3 The Creator further grants to INFOMEDIJI and PICO a non-exclusive, worldwide, perpetual, sublicensable licence to use, reproduce and display the VR Content and related materials for promotional purposes relating to the Campaign, including on INFOMEDIJI’s social media channels and other promotional platforms of its choosing. INFOMEDIJI shall be the sole arbiter of such promotional use.
20.4 Nothing in this Clause 20 is exclusive. The Creator may continue publishing, licensing and monetising the same VR Content on other platforms.
20.5 Any revenue earned by the Creator through the DeoVR Monetization Program in respect of the VR Content belongs to the Creator, in accordance with the DeoVR Terms.
20.6 The Creator’s submissions must be original, created solely by the Creator, and must comply with the DeoVR Terms, PICO Community Guidelines, and all applicable laws and regulations. The Creator’s submissions must not contain any third-party Intellectual Property Rights unless the Creator can provide an unrestricted licence to use such Intellectual Property Rights for the purposes of the Campaign, and such right may be sublicensed to INFOMEDIJI and PICO in accordance with Clause 20.2. It is the responsibility of the Creator to ensure that any such transfer or sublicensing is completed prior to receipt of any Funding.
20.7 Submissions must be free of any dongle, clock, timer, counter, hardware key, copy protection feature, replication device, “virus” or “worm” as those terms are commonly used in the computer industry, or other software code that may lock, disable or erase any of the Intellectual Property Rights, or any other software, programs or data contained within the submission.
20.8 If any material is found not to be owned or controlled by the Creator, and no evidence of the right to use and licence the Intellectual Property Rights has been provided, the Proposal or VR Content will be disqualified.
20.9 As a condition of receiving Funding, Selected Creators must agree to all of the conditions outlined in this Section 20.
21. Payment of Funding
21.1 Where applicable, INFOMEDIJI’s processing of payments takes place Monday to Friday, excluding weekends and public holidays.
21.2 Funding will be paid by bank transfer to the account details provided by the Creator. INFOMEDIJI shall not be held responsible if those bank details are incorrect or incomplete.
21.3 Once Funding has been transferred to the Creator’s designated account, all risk in respect of those funds passes to the Creator.
21.4 Any dates communicated to a Creator regarding the timing of Funding payment (whether in the Content Licensing Agreement or otherwise) are approximate only and not an essential term of these Conditions. INFOMEDIJI shall have no liability in respect of any delay in payment of Funding.
21.5 The Creator is responsible for providing all documentation required by INFOMEDIJI to process payment in accordance with Clause 19.4, prior to any Funding being paid.
21.6 Third-party terms and conditions may apply to parts of the payment process where applicable (including banking and payment service provider terms).
21.7 INFOMEDIJI shall not be responsible for any legal, regulatory, banking, payment, or export restrictions imposed by any country or authority that may affect the payment or receipt of Funding. Any such issue shall be treated as a Force Majeure Event under these Conditions.
21.8 INFOMEDIJI may, at any time, require the Creator to provide additional identification, proof of age, tax, banking or other compliance documentation reasonably necessary to process any Funding or to comply with applicable law, including anti-money laundering, sanctions and export control requirements, and may delay or withhold Funding until such documentation is provided.
22. Indemnification
22.1 The Creator shall indemnify INFOMEDIJI and PICO, and keep each of them indemnified, against any liability to any third party arising out of or connected with the Creator’s use of any Funding or participation in the Campaign.
22.2 The Creator hereby indemnifies and holds harmless INFOMEDIJI and PICO against all claims, demands, losses, damages, costs or expenses howsoever arising and incurred by either of them in connection with these Conditions as a result of a breach by the Creator of any provision of these Conditions, any applicable law or regulation, or any third-party rights.
22.3 The Creator acknowledges and agrees that PICO is entitled to directly enforce, and to receive the benefit of, the indemnities given to PICO under this Section 22, notwithstanding that PICO is not a party to these Conditions or to the Content Licensing Agreement.
23. Eligibility
23.1 Employees (or members of the families or households of employees) of INFOMEDIJI and PICO, as well as INFOMEDIJI’s and PICO’s contractors, agents, and business partners (and members of their families or households) are not eligible to participate in the Campaign. INFOMEDIJI reserves the right not to award Funding if We are aware or have reasonable grounds to believe that a Creator is not eligible.

Funding:
- Up to USD 1,000 (One Thousand United States Dollars) per approved Proposal, awarded following review of the Proposal and, subsequently, the final VR Content.
- The exact Funding amount for each Selected Creator will be determined by PICO and the DeoVR Content Team and confirmed to the Creator by email.
All Funding, including any applicable taxes, including but not limited to withholding taxes, shall be the sole responsibility of the Creator.
